ARTIST LICENSE RELEASE

We cannot use your artwork and/or photographs, or the likeness of the persons in the artwork and/or photographs, without your agreement. By uploading your images to http://www.flickr.com/groups/tnasubmissionseries/ you are agreeing to the terms set out below.

In consideration of the credit that Aritzia LP will be giving me for my artwork, if it is used, on its TNA website, I hereby grant Aritzia LP, its successors and assigns, doing business as Aritzia and TNA, an irrevocable:

  1. license to use and modify my enclosed/uploaded artwork and/or photographs; and
  2. right to use and modify the likeness of any persons in the artwork and/or photographs (having obtained such right from such persons),
    now or at any time in the future throughout the world. This license and right to use and modify includes, but is not limited to, the use of my enclosed/uploaded artwork and/or photographs, and the likeness of the persons therein, on the TNA web site, stickers, packaging and on corporate and miscellaneous marketing collateral, whether alone or in a composite form and whether the image results in blurring, distortion, alteration or optical illusion. I acknowledge and agree that I shall have no right of approval with respect to the use or modification of my artwork and/or photographs, or the likeness of the persons therein, by Aritzia LP. I further acknowledge and agree that there will be no fees, commissions or royalties paid to me (or any persons in the artwork and/or photographs) in connection with the license and right granted herein or the use or modification by Aritzia LP of any of my artwork and/or photographs or the likeness of any of the persons therein.

I represent and warrant to Aritzia LP that:

  1. I am the owner of the enclosed/uploaded artwork and/or photographs;
  2. I have the exclusive right and authority to grant the license granted herein; and
  3. I have obtained the right to use the likeness of all persons in the artwork and/or photographs, and to grant others the right to use their likeness, on terms that are consistent with the terms and conditions contained herein.

 

I hereby release Aritzia LP from any claims I may have, and agree to indemnify Aritzia LP from any claims made by any persons in my artwork and/or photographs, arising out of the license and rights granted herein.
I acknowledge that Aritzia LP is under no obligation to use my artwork and/or photographs, or the likeness of any persons therein. However, wherever Aritzia LP uses the artwork and/or photographs or the likeness of any persons therein, I authorize Aritzia LP to credit my artwork and/or photographs with my name on its TNA website (and otherwise in its discretion).
